These Terms of Service (“Terms”) govern your use of 5-picks.comand the 5 Picks game (the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Who can use the Service

You must be at least 13 years old (or 16 in the European Economic Area), or have the consent of a parent or legal guardian. By using the Service you represent that you meet these requirements.

The Service

5 Picks is a free, browser‑based basketball simulation game: you draft all‑time rosters by team and era and watch a deterministic engine simulate a game. It is provided for entertainment only. Simulated results are fictional and do not predict real‑world outcomes.

Not affiliated with the NBA

5 Picks is an independent fan project. It is not affiliated with, endorsed, sponsored, or approved by the National Basketball Association (NBA), its teams, its players, or any related entity. All team names, player names, and related marks are the property of their respective owners and are used here for identification and informational purposes only. Player statistics are derived from publicly available sources (such as Basketball‑Reference, via a public‑domain dataset).

Accounts

Some features may require an account, which you can create by signing in with Google. You are responsible for activity under your account and for keeping your access secure. Tell us promptly at [email protected] if you suspect unauthorized use.

Acceptable use

You agree not to:

• cheat, exploit bugs, or manipulate match results, ratings, or leaderboards;
• use bots, scrapers, or other automated means to abuse the Service;
• harass other players or post unlawful, harmful, or infringing content;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

Intellectual property

The 5 Picks software, design, and original content are owned by us or our licensors. Third‑party data, names, and marks remain the property of their respective owners. We grant you a personal, non‑exclusive, non‑transferable license to use the Service for your own non‑commercial entertainment.

Advertising

The Service is supported by advertising, including Google AdSense. Your interactions with ads are subject to the advertisers’ and Google’s terms and policies. See our Privacy Policy for how advertising cookies are handled.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or secure.

Limitation of liability

To the maximum extent permitted by law, 5 Picks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us (if any) in the 12 months before the claim — which, for a free service, is typically zero.

Changes and termination

We may modify or discontinue the Service, or update these Terms, at any time. Material changes will be reflected by the “last updated” date above. We may suspend or terminate access that violates these Terms.

Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict‑of‑law rules. The competent courts of Israel will have exclusive jurisdiction over any dispute, to the extent permitted by applicable law.
